TERMS & CONDITIONS – UNLISTED PERFORMANCE
Delivery and Backorders
By placing an order with Unlisted Performance through our website, phone, text, social media, or email, you agree to the following terms. Unlisted Performance maintains regular stock levels, however some products require backordering or custom manufacturing. In-stock items generally ship within approximately fifteen business days and typically arrive within five to ten business days after shipment. Made-to-order or non-stock items require a four to eight week lead time, which may be extended due to holidays, freight delays, material shortages, or other circumstances beyond our control. Backorders must be canceled within five days from the date of purchase. After this period, production begins and cancellations are no longer permitted. All delivery dates are estimates only. The buyer is responsible for all freight and delivery charges unless otherwise arranged. Unlisted Performance will maintain communication with buyers regarding any changes to estimated delivery dates.
Warranty and Disclaimer
Some products sold by Unlisted Performance may not be legal for street use depending on state laws, and it is the buyer’s responsibility to comply with all regulations. All products are intended for off-highway or competition use unless otherwise stated. Due to strict U.S. Federal and State safety regulations, Unlisted Performance is not responsible or liable for damages, injuries, or losses caused by improper installation, vehicle accidents, driver error, modifications, misuse, negligence, or acts of nature. The buyer is solely responsible for ensuring that products are suitable for their intended use and that they are installed correctly. Unlisted Performance assumes no liability for direct or indirect damage to vehicles, occupants, or related components.
Product and Delivery Damage
Unlisted Performance packages all items securely to prevent damage, but shipping damage may still occur. The buyer must inspect all packaging and products upon delivery before signing. Any damage such as crushed, torn, punctured, or broken packaging or parts must be noted on the delivery receipt. The buyer must take a minimum of three photos of both the box and the product and email them within twenty-four hours to unlistedperformance@gmail.com with the order number as the subject line. All packaging materials must be kept for inspection. A clear delivery signature without noting damage releases Unlisted Performance from all responsibility related to future damage claims. Damage discovered after a clear delivery signature becomes the responsibility of the customer.
Returns and Refunds
Products cannot be returned or exchanged without approval. The buyer must request a Return Authorization (RA) within three days of receiving the item. If approved, the item must be returned to Unlisted Performance within ten days of RA issuance. Any return sent without an RA number will be refused and returned at the buyer’s expense. Items that have been used, installed, modified, painted, or altered in any way are not eligible for return. Custom-made, made-to-order, or special-order products are non-returnable. Defective items may be exchanged for the same item only after inspection by Unlisted Performance. Approved returns are subject to a twenty percent restocking fee. Shipping, freight, and handling fees are non-refundable. All refunds are issued as store credit only. The buyer is responsible for return shipping and must insure the shipment for its full value. Refunds or credits will not be issued for products damaged after delivery or during return transit.
Contingencies
All parts remain the property of Unlisted Performance until paid in full. Prices, product specifications, and store policies are subject to change without notice. Unlisted Performance is not responsible for delays caused by shipping carriers, manufacturers, suppliers, or other events outside of our control.
